  • Interperation of regulations province of Newfoundland

Just reading my local regulations WRT atv. A friend was telling me that here in Newfoundland they are not allowed to ride ATV in the swamp/marsh land areas. Had to go do some digging to find the regs and have a read for myself. They define an ATV as a

    (g) "vehicle", where used in section 3, sections 9, 10, 16 and 17, means a 2, 3 or 4 wheeled type vehicle designed to be operated with the driver seated astride a seat and commonly known as a trail bike or all-terrain vehicle.

I guess this means that I can take my 6 and 8 wheelers anywhere as they do not meet the above standard.....

that what its says to me also, when laws are written in detail and an absolute description is given then what you have to operate is within the law, for example this last year in california they amended a law stating that you must wear a helmit in the GLAMIS dunes and it describes the vehicles that you must wear them in as having certain c.c and must have a steering wheel for steering, that means any vehicle that does not, like a 6x6 with sticks to steer is exempt. so hold them to the law..

Let me start by asking you whether or not you can register your 6/8 wheeler in Newfoundland without insurance coverage?

Section 16 and 17, that are referred to, talk about insurance coverage and in Section 3 (1) of the
MOTORIZED SNOW VEHICLES AND ALL-TERRAIN VEHICLES ACT it states that you cannot register your 6/8 wheeler without insurance. I'd be interested in hearing how the discussion went at registration renewal time.

Section 9 refers to multi-passenger vehicles so I don't think you'd have any problems there.

Section 10 (3) (c) says that you don't need a helmet, googles/windshield if your vehicle has more than 4 wheels. Again there doesn't appear to be an issue.

Section 3 refers to section 8(2) and (3) as well as 9 and 10. Sections 8(2) and (3) refer to "all-terrain vehicle" which has a different definition than the "vehicle" definition you are referring to. It would appear that you have to be 16+ years old to operate a 6/8 wheeler (and probably need some type of license).

All of these things relate to registration, insurance and to some extent safety. What is the connection between these and being able to take your 6/8 wheelers anywhere? I know that Newfoundland has restrictions on where all-terrain vehicles can be operated so I'm curious.

          Hi Northof60,

Yes you can register your AATV here in newfouindland without insurance. When I first bought my 8 wheeler and went to the DMV there were no questions asked. Just pay your fee. (A)ATV registration in newfoundland is a one time thing unless you transfer/sell your machine.

As for age limit, for an adult size ATV you must be at least 16yrs of age. 14 and 15 yr old can operate an ATV with an engine size under 90cc under the direct supervision of an adult (is accompanied and supervised when the other person has visual and voice communication with the operater)

Wow, need insurance here in the NWT to register. I don't think any Argo owners do though because they mostly stick to the bush.

Can you tell me if the Trans Canada Trail is open to ATVs.

            Thanks

Yes the TCT is open to ATVs here on the rock. Have to be careful in places due to wash outs caused by recent flooding. There are a couple sections closed until further notice due to washout.

If you cross highways then you are supposed to have insurance......
