  • FL ORV permit for an Amphibious ATV

    the state of florida tells me I can not ride in a national forest with an aatv. They will not issue an orv permit because my maxiv does not fit the requirements for an atv.

    I have an Off Highway Vehicle (OHV) decal for my MaxIV from the tag office. I ride on the designated ATV trails in the National Forest. I think they say 50inches wide. I know that I am 54. Haven't been stopped yet, and consider myself legal. Plenty of the 4 wheelers are wider than I am.

      DMV defines OHV as:

      Off-Highway Vehicles
      In Florida, both ATVs and OHMs fall under the umbrella of off-highway vehicles (OHVs). What exactly is an OHV? It's defined by state lawmakers as any ATV, two-rider ATV, or OHM meant to be used off the state's roads and highways, and that isn't registered and licensed for highway use.


      The Florida DMV defines an ATV as the following:

      ATV
      This is a motorized vehicle meant for a single rider. It will be 50 inches or less in width, with an unladen dry weight of 900 pounds or less. It travels on three or more low-pressure tires, and has a seat that the operator straddles. It also has a handlebar-type steering control.


      They sold me a sticker, so I must be an OHV! Thats my story and I'm stickin' to it!

            First of all do NOT tell them your are an amphib. they will try to send you to the US Coast Guard for inspection. Next, I just brought my title down to the the Tag office and said that I needed to register an ATV. I do know that Max and Argo are in their system, not sure about out of production units.

            I had to make a two trips. The first time I told them I was an amphibious vehicle, which was a big mistake. Went back later and registered as an OHV.

            Good luck and use the term ATV as much as you can.

            Another idea would be to register as a custom built vehicle and make it "street Legal" Whipper did this in Arizona.

              My max is a 1985 model. I cannot get a title for it.. RI was unwilling to help me because im not the origonal owner.

                It's an off road vehicle. They don't have a title. R.I. issues am Manufactures Certificate of Orgin. If you have a Bill of Sale the should be good enough. If you have a Bill of sale you should be able to appy for a title.

                  I was in the same situation once with a man whom I was selling a used Harley engine to . He wanted a title to go with the Harley engine he was buying from me , so he could build a motor cycle and later get it licenced at the DMV . I knew that the motor I was selling was not stolen , because I had bought it used from a friend of mine I trusted . To solve my problem , I had the local DMV run a title search on the engine I was selling to see if it was stolen . It was not reported stolen or missing , but the local DMV could not locate the original owner . A friend of mine gave me a tip on how to solve my problem . He said that I could give the buyer of the Harley engine I was selling , a signed bill of sale and a copy of my drivers licence , as proof of purchase . The buyer of the engine I sold to , would then go to the local Justic of the Peace , and apply for an affidavit . I would then sign the affifavit he brought me , saying the engine was not stolen . The Justice of the Peace would then issue the man I sold the Harley engine to , a builders title . It would then no longer be a Harley Davidson , but a custom built motor cycle in the year it was completed ,and licenced at the DMV. I hope this helps you .

                      If I were you, I would call the tag office on the phone and say that you bought an older ATV w/o a decal and ask what they need from you?
